This training on Data Protection Act was developed in collaboration with Philipp Fischer.
Philipp Fischer holds a law degree from the University of Geneva (2004) and a Geneva bar exam (2007). He obtained a Master of Laws (LL.M.) from Harvard Law School (2009). After working in law firms in New York, Zurich and Geneva (2010 – 2016), he co-founded OBERSON ABELS SA in 2016. He practices banking and financial law, as well as data protection law.

The first federal law on data protection dates back to 1992. In the meantime, the Swiss population has introduced the use of the Internet and smartphones into their daily lives, and is increasingly using social networks, the cloud and the Internet of Things.
In this context, a complete overhaul of the data protection law – and no longer only partial as in 2009 and 2019 – is indispensable to ensure that the population has adequate data protection that is adapted to the technological and social developments of our time.

The compatibility of Swiss law with European law, and in particular with the European Data Protection Regulation (GDPR), is the other main challenge of the new law. The FADP should make it possible to maintain the free flow of data with the European Union (EU) and thus avoid a loss of competitiveness for Swiss companies.
